Welcome to our website www.silly-beer.com. The website is brought to you by Brasserie de Silly SA. These terms and conditions apply to your use of the site. We only comply with our terms and conditions.
2. CONDITION OF SALE
2.1 MINIMUM FOR ALCOHOL CONSUMPTION
2.1.1 We sell craft and specialty beers through our website (‘Products’).
2.1.2 We sell and deliver our products to people who have reached the minimum age of 18, (16 for Belgium).
2.1.3 We have incorporated various age controls into the ordering process in order to comply with our statutory requirements.
2.2 OUR PRODUCTS
2.2.1 Our site is intended exclusively for the promotion of our products in Belgium.
2.2.2 Our products are suitable for consumption. We guarantee that the products we supply are in accordance with their descriptions on the website and their labels, that they are of good quality and that they comply with statutory requirements.
2.2.3 We recommend that the products be stored in a dry place, not exposed to direct sunlight or rain and not stored at temperatures below 0 degrees or in the open air.
2.2.4 The products are intended for end consumers and you are not expected to resell them.
2.3 ORDER AND ORDER CONFIRMATION
2.3.1 You can order by choosing the products you want, complete the required information and follow the instructions on your screen. You can check the details when placing an order and correct any errors before placing an order. Take the time to read and verify your order details during your order process
2.3.2 Before placing an order, you will be asked to confirm that you accept the terms. If you have any questions about the terms, please contact us before ordering.
2.3.3 When you are ready to order, you can follow the ordering process and place it by clicking on the “Checkout” button on the order page. Once you have clicked on “Payment”, you will no longer be able to modify your order. You will be directed to the page of our payment partner (mollie) to complete the payment.
2.3.4 Once payment has been made via the payment page, you will receive an email confirming that your order has been placed (“Confirmation email”). This email contains information about your order, such as the list of products and prices (including delivery and taxes), and additional information about the order. Keep this confirmation email. If you have not received a confirmation email the day after your order, please contact us.
2.3.5 The agreement will be concluded between the Brasserie de Silly and you when you receive the confirmation email
2.3.6 We reserve the right to cancel your order if the products are no longer available or if full payment has not been received. We also reserve the right to refuse or cancel your order at any time if we have reason to suspect that the purchaser or recipient is not of the minimum age to purchase alcoholic beverages.
2.3.7 If your order has been deleted, we will notify you and refund you as soon as possible (no later than 14 days after cancellation).
2.3.8 If we cannot complete your order because the products are not available, we will contact you by email or telephone to offer you a reasonable alternative of products, or we will notify you when the products are available again. The decision is yours as to which alternatives we offer. Your decision will not affect your cancellation rights.
2.4 PRICE AND PAYMENT
2.4.1 All prices and charges on the site are in euros, including transport in Belgium, VAT and excise duties.
2.4.2 The prices of the products are the prices indicated on the order page of the site when you place your order. Prices can be adjusted from time to time without warning. However, price changes are no longer valid once your order has been accepted, except for specific technical errors, to which we are not related. If we accept your order and start preparing it, making an error in the price, we have the right to delete your order, refund you any money already received and request the return of the products that have been delivered to you.
2.4.3 You pay for your products using only the payment methods listed on the website. We do not accept other payment methods.
2.4.4 All payments are made through an external payment service. They are subject to the terms and conditions of the latter.
2.4.5 By paying for an order with a credit or debit card, you represent that it is your property.
2.4.6 All cardholders are verified, and issuers are required for authorization. If your card issuer does not authorize payment for us, we cannot accept the order. In this specific case, we cannot be held responsible for any delays or non-delivery.
2.5 DELIVERY INFORMATION
2.5.1 We deliver in Belgium via Bpost. If you placed your order before 5:00 p.m., we have the option of delivering it to you within 24 hours. Note that we do not process orders on Saturday and Sunday.
2.5.2 Delivery is free for complete packs. A complete pack contains 12 bottles. If you order an incomplete pack, the Brasserie de Silly applies a delivery charge of 8.25 €, this is then indicated on the site, during the ordering process and in the confirmation email.
2.5.3 Your order will be delivered to you by BPost, on the day of the scheduled date, you will receive an email from BPost with a link to track your package.
2.5.4 Persons receiving a delivery of alcoholic products must be of the minimum legal drinking age. The delivery person can indicate this minimum age and request a justification. The delivery person may refuse to deliver the products if the justification provided is not valid.
2.5.5 If no one is at home or if the person present is not an adult, the delivery person can keep the package and leave a calling card in your mailbox.
2.6 RETURN AND CANCELLATION
2.6.1 If you wish to cancel your order, you have the right to withdraw from this contract without giving any reason within fourteen days. The withdrawal period expires fourteen days after the day on which you, or a third party other than the carrier and designated by you, takes physical possession of the last good.
2.6.2 We prefer that you contact our customer service on +32 68 25 04 80 (Monday to Friday, 10 a.m. to 5 p.m.), or send us an email via email@example.com . To exercise the right of withdrawal, you can also notify us of your decision to withdraw from this contract by means of an unambiguous declaration by post to the address Brasserie de Silly SA – Rue Ville Basse 2 – 7830 Silly. We ask you to enter your order number (indicated in the confirmation email).
2.6.3 To return your order, you can contact our customer service by email firstname.lastname@example.org informing us of the reason for the return. We will then send you a return slip already prepaid by Bpost. All you have to do is drop off the parcel at a relay point, at a machine or at a post office.
2.6.4 We will refund the price of the products and any delivery charges you paid to receive our products. Return costs via BPost are at our expense.
2.6.5 We will refund you as soon as possible, but no later than 14 days after purchase, with the same payment method you ordered. However, we cannot process a refund until we have received the products or (if there is none) proof of the return.
2.6.6 Information about canceling your order and using your rights can be found in the confirmation email and on our website in point 2.6 “RETURNS AND CANCELLATION”.
2.6.7 Each returned product must be in perfect condition for resale, with the exception of defective products. We reserve the right to deduct a portion of the refund for any loss in value of product issued to you, if such loss is due to unnecessary handling or damage on your part.
2.6.8 In accordance with Belgian law (article VI.53 WER), we, as an entrepreneur, may exclude certain products and services, but we clearly state this in our offer. However, we are under no obligation to explain these exclusions.
2.6.9 Your responsibility is only engaged with regard to the depreciation of the good resulting from manipulations other than those necessary to establish the nature and the characteristics of this good.
3.1.1 We collect information from visitors to our website, and from people who enter into an agreement with us. We use many cookies on our website. Our privacy and cookie policies apply to our entire website.
3.2 INTELLECTUAL PROPERTY RIGHTS

4.1.2 If the products do not meet the quality standards required on the affected product, please notify us as soon as possible within 14 days. 4.2 AMENDMENTS TO THESE TERMS AND CONDITIONS
4.2.1 We recommend that you print these terms, or save them on your computer for future use. However, each time you use the website, you should review the Terms and Conditions before agreeing to the Terms, so that you are always aware of them.
4.2.2 Each article in these terms is valid separately. If a court or competent authority decides that one or more articles are invalid, the other articles may remain.
4.3 APPLICABLE LAW AND JURISDICTION
4.3.1 The interpretation of these Terms and Conditions and agreements is subject to Belgian law. Any dispute will be brought before the courts of the judicial district of the registered office of Brasserie de Silly SA.
